Agreement to Terms

These Terms of Service govern your access to and use of the Factor Sales platform, website, and related services provided by Pearson Ham Group.

By creating an account or accessing the Factor Sales platform, you agree to be bound by these terms. If you are using the platform on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

Platform Services

Factor Sales provides market intelligence, pricing analytics, and benchmarking tools for the UK automotive aftermarket. All data presented on the platform is derived from anonymised, aggregated sources and is intended for informational and strategic purposes only.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree not to share login details or attempt to access data or features beyond your subscription tier.

Intellectual Property

All content, data visualisations, reports, and analytical tools provided through the Factor Sales platform are the intellectual property of Pearson Ham Group. You may not reproduce, distribute, or resell platform content without prior written consent.

Prohibited Uses

You may not use the platform to attempt to reverse-engineer anonymised data, identify individual businesses, or extract data in bulk through automated means. Violation of these terms may result in immediate account suspension.

Data & Privacy

Your use of the Factor Sales platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the platform, you consent to the data practices described in that policy.

Subscription & Payment

Access to certain features of the Factor Sales platform requires a paid subscription. Subscription fees are billed in accordance with your chosen plan. You agree to provide accurate billing information and to keep it up to date. Failure to maintain payment may result in suspension or downgrade of your account.

Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms of Service. You may also cancel your account at any time by contacting us at info@factorsales.com. Upon termination, your right to access the platform ceases immediately.

Limitation of Liability

To the fullest extent permitted by law, Pearson Ham Group shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Factor Sales platform. Our total liability for any claim arising from these terms shall not exceed the amount you paid for the service in the twelve months preceding the claim.

Changes to These Terms

Pearson Ham Group reserves the right to modify these Terms of Service at any time. Continued use of the platform following any changes constitutes acceptance of the updated terms. Material changes will be communicated via email to registered users.
